In order to accelerate the all-round elderly care service system, strengthen the planning and construction of elderly care service facilities, and constantly promote the high-quality development of elderly care services. Recently, the Shaanxi Provincial Department of Civil Affairs, the provincial Department of Natural Resources and the provincial Department of Housing and Urban-Rural Development jointly issued the Guiding Opinions on Strengthening the Planning and Construction of Elderly Care Service Facilities.




The opinions specify the scope of land use


Land for elderly care service facilities refers to land used by houses and site facilities that specifically provide living care, nursing care, rehabilitation nursing, medical and health services for the elderly, including land for institutional elderly care service facilities such as nursing homes, welfare homes, nursing homes for the elderly, nursing homes for the elderly, and town streets and community elderly care service facilities such as elderly care service centers and day care centers.



The guideline calls for special planning


The civil affairs department of each city and county shall, together with the department of natural resources, formulate a special plan for the layout of elderly service facilities in accordance with the overall plan of national territory and space according to the factors such as the distribution of the elderly population, public service resources, and the demand for elderly service services in the administrative area, and after submitting it to the people's government at the same level for approval, the main contents of the special plan shall be incorporated into the detailed plan and implemented simultaneously. Priority is given to reserving land for elderly care service facilities around medical institutions and areas with large demand for elderly care land.



Advise and coordinate the layout of facilities


When preparing detailed plans, the natural resources departments of cities and counties should implement the relevant requirements of the overall territorial space plan, fully consider the needs of the number, structure and layout of elderly care service facilities, specify the location and indicators of elderly care service facilities that occupy an independent area, and specify the content and scale requirements of elderly care service facilities that do not occupy an independent area. New urban areas and new residential (small) areas shall, in accordance with the corresponding national standards and norms, support the construction of elderly care service facilities, and synchronize with residential planning, construction, acceptance and delivery.



Opinions regulate the supply of land


Land for old-age service facilities in institutions such as nursing homes, welfare homes, nursing homes for the aged, and nursing homes is generally provided separately. We will encourage the use of land for elderly care facilities to be compatible with the construction of medical and health facilities. To fully protect the needs of non-profit elderly care service institutions for land allocation, non-profit elderly care service institutions may, based on the opinions of local civil affairs departments and other statutory materials, apply to the local municipal and county natural resources departments for planning permission for construction land, and after being approved by the people's government with the power to examine and approve construction land, Municipal and county departments in charge of natural resources shall simultaneously issue construction land planning permits and decisions on state-owned land allocation. The land for for-profit elderly care service facilities shall be used as state-owned construction land by way of transfer and lease, and the method and period of transfer and lease shall be determined by all localities in accordance with relevant state regulations. Where the land use right holder applies for changing the use of the stock land for the construction of elderly care facilities, and after examination, it conforms to the detailed planning, the municipal and county departments in charge of natural resources shall handle the formalities for changing the land use according to law and regulations. Where the completed elderly care service facilities are used by non-profit elderly care institutions, the original allocated land may continue to be allocated for use, and the original paid use of land may not increase the land price. If the conditions for allocation are not met, the land originally allocated for use shall, with the approval of the municipal and county people's governments, go through the formalities for compensated use according to law and pay the land transfer price in return; For the land originally used for paid use, the land use right holder may sign an agreement to modify or re-sign the contract for paid use of state-owned construction land with the municipal or county natural resources departments in charge, so as to adjust the paid use price.




Encourage the use of commercial, office, industrial, storage housing stock and community housing to set up elderly care institutions, the use of stock housing in line with detailed planning and does not change the subject of the land can be implemented within five years according to the original use of land and rights type of the transitional policy.



We will coordinate the construction of elderly care service facilities in rural areas


In the preparation of practical village planning, the number, structure and layout requirements of elderly care service facilities should be fully considered, and the location and indicators should be clearly defined for independent land use, and the construction content and scale should be clearly defined for non-independent land use. Encourage the use of rural collective construction land for the development of elderly care service facilities, rural collective economic organizations can use the construction land owned by their collective economic organizations in accordance with the law to set up elderly care service facilities together with other units and individuals in the form of construction land use rights as shares, joint ventures, etc. We will encourage the use of idle school buildings and factories in rural areas to rebuild elderly care facilities such as nursing homes, activity centers for the elderly, and mutual assistance and happiness homes.




Strict review and approval process


Elderly service facilities in residential areas shall be constructed and transferred to use in accordance with the principles of synchronous planning, synchronous construction, synchronous acceptance and synchronous delivery. The municipal and county departments in charge of natural resources shall strictly examine the construction engineering design scheme of the new residential project, and shall not issue the construction project planning license or pass the planning verification if the elderly service facilities do not meet the requirements of the planning conditions.
